ISLAMABAD, Pakistan: The Supreme Court of Pakistan has taken suo motu notice of the letter written by six judges of the Islamabad High Court (IHC) regarding the interference of secret agencies in judicial functions.

The seven-member larger bench of the Apex Court headed by the Chief Justice Qazi Faez Isa will hear the suo motu case on Wednesday at 11:30 am.

Other members of the bench will include Justice Mansoor Ali Shah, Justice Yahya Afridi, Justice Jamal Mandokhel, Justice Athar Minallah, Justice Musarrat Hilali and Justice Naeem Akhtar Afghan.

Meanwhile, the former Chief Justice of Pakistan Justice (retd) Tassaduq Hussain Jillani has recused himself from heading the Inquiry Commission formed to investigate the letter written by six IHC judges alleging interference by intelligence agencies in judicial matters.

In his letter to Prime Minister Shahbaz Sharif, Tassaduq Hussain Jillani expressed dissatisfaction with the Terms of References (TORs) of the Inquiry Commission, saying that they were not strictly relevant.

I have gone through the afore-stated letter of the six judges and the terms of reference approved by the Cabinet as well as the relevant constitutional provision (Article 209). Since the letter is addressed to the members of Supreme Judicial Council and its chairman the Chief Justice of Pakistan, it would be violative of judicial propriety for me to inquire into a matter which may fall within the jurisdiction of a constitutional body which is the Supreme Judicial Council or the Supreme Court of Pakistan itself,” read his letter dated April 1, 2024.
