KARACHI: A petition was filed in the Sindh High Court (SHC) on Thursday, demanding the court to declare the Protection of Pakistan (Amendment) Ordinance 2014 null and void because it is against the basic Islamic laws as article 227 of the constitution clarifies that no laws will be made against the Quran and Sunnah.
The petitioner further argued that detention of missing persons is against the Islamic laws, therefore it should be termed void.
Earlier, President Mamnoon Hussain promulgated the Protection of Pakistan (Amendment) Ordinance 2014, which is designed to fight terrorism and lawlessness in Karachi and other restive parts of the country and deal with the missing persons issues.
In the ordinance, a new clause was added besides other amendments according to which combatant enemy means any person who raises arms against Pakistan‚ its citizens‚ the Armed Forces or Civil Armed Forces or aids or abets the raising of arms or waging of war against Pakistan or threatens the security and integrity of Pakistan.
The ordinance states that the government may authorize detention of a person, if in the opinion of the government‚ is acting in a manner prejudicial to the integrity‚ security and defense of Pakistan.
