ISLAMABAD, Pakistan: Islamabad High Court (IHC) Friday declared the appointment of Acting Chairman Capital Development Authority (CDA) Sheikh Anser Aziz as null and void.
Justice Athar Minallah announced the judgment in a petition filed by citizens including Farrukh Nawaz Bhatti and others challenging the appointment of mayor Islamabad as executive member CDA and then acting chairman of the body.
In its decision, the court suspended the notification dated September 6, 2016 of Aziz’s appointment as the executive member of the civic body, following that he was given the acting charge of the chairman of CDA.
The court directed the federal government to initiate process for appointment of an eligible officer as chairman of CDA amongst the members under CDA Ordinance 1960 for a period of five years.
The court gave forty five days to complete the process.
It may be mentioned here that the petitioners filed the plea in September 2016, against the appointment of acting chairman of CDA, stating that legal procedure was not adopted in his appointed and prayed the court to declare the notification in this regard as null and void.
