Islamabad, Pakistan: Supreme Court of Pakistan has called the ruling of the Speaker of the National Assembly unconstitutional and restored the National Assembly. Supreme Court also called the decision of the President illegal and unconstitutional. The decision was unanimous and all judges had the same judgement.

The larger bench of the Supreme Court of Pakistan on Thursday set aside the ruling of the Speaker of the National Assembly to bulldoze the Vote of No-Confidence Motion against the then Prime Minister Imran Khan and the ruling subsequently led to the illegal and unconditional dissolution of the National Assembly. The dissolution of the National Assembly is also called Unconstitutional. The Court has restored the National Assembly.

After hearing all the parties for five days, a larger bench comprising of five judges headed by the Chief Justice of the Supreme Court of Pakistan Umar Ata Bandial announced the decision against the ruling of the Speaker of the National Assembly who trashed the Vote of No Confidence against the then Prime Minister Imran Khan without voting on the motion when 177 members of the opposition were present in the House to vote Imran Khan out of PM office while only 172 votes were needed for the success of the Vote of No Confidence.

The Speaker trashed the Vote of No-confidence against Imran Khan then he advised President Arif Alvi to dissolve National Assembly and President dissolved the Assembly under his advice. Imran Khan could not dissolve Assembly under the rules laid by the Constitution because he was facing the Vote of No Confidence Motion.

On Thursday, April 7, 2022, during the proceeding judges observed that it was clear that the ruling of the deputy speaker to dismiss the no-confidence motion submitted against the prime minister was “wrong”.

The bench was compromised of Chief Justice Umar Ata Bandial, Justice Munib Akhtar, Justice Jamal Khan Mandokhel, Justice Ijazul Ahsan, and Justice Mazhar Alam Khan.

It is pertinent to mention that Attorney General for Pakistan Khalid Jawed Khan could not defend the ruling of reading by the deputy speaker and signed by the Speaker.
