Islamabad, Pakistan: While granting consular access to Indian spy Kulbhushan Jadhav, the International Court of Justice (ICJ) allowed Pakistan to keep Indian terrorist within its boundaries (Pakistan) and deal with him according to Law of the Land.

Law of the Land (Pakistan) is clear enough to convict a terrorist under anti- terrorist mechanism and Kulbushan Jadhav would not be an exception.

Indian plea for release of Kulbushan Jadhav or handing over to India licked the dust and Pakistan successfully pleaded that Kulbushan Jadhav is not a normal foreign national rather a terrorists and spy who operated in Pakistan for executing terror attacks all over Pakistan killing thousands of innocent Pakistanis.

Who is Kulbushan Jadhav?

Jadhav was arrested by Pakistani intelligence agencies on March 3, 2016 from Balochistan after a long, painstaking and coordinated operation.

Kulbhushan Jadhav (Kulbhushan Yadev) recorded a confessional statement in which he confessed that he planned several acts of terrorism in Pakistan and was looking after a networking of terrorists spread from Karachi to Balochistan.

Yadav, in the video released by Pakistan, said “I am still a serving officer in the Indian Navy and will be due for retirement in 2022. By 2002, I commenced intelligence operations. In 2003, I established a small business in Chabahar in Iran. As I was able to achieve undetected existence and visits to Karachi in 2003 and 2004 and, having done some basic assignments within India for RAW, I was picked up by RAW in 2013”.

In May 2017, India approached the ICJ, asserting that Pakistani authorities were denying India its right of consular access to Jadhav in violation of Vienna Convention.

The ICJ proceedings began in Hague on May 15, 2017 to review the case. India and Pakistan both sent their legal teams to put forward their arguments, led by Harish Salve and Khawar Qureshi respectively.

On May 18, 2017, the International Court of Justice stayed the hanging of Kulbhushan Jadhav.

Pakistan has said that it would proceed with regard to the judgment of the International Court of Justice (ICJ) in Kulbhushan Jadhav Case as per law, the Dispatch News Desk (DND) news agency reported.

In a statement, the Foreign Office said that Pakistan, as a responsible member of the International community, upheld its commitment from the very beginning of the case by appearing before the honourable court for the provisional measures hearing despite a very short notice.

“Having heard the judgment, Pakistan will now proceed as per law,” the Foreign Office said.

The Foreign Office said that it is reiterated that the Indian Naval Commander Kulbhushan Jadhav entered Pakistan without a visa on authentic Indian Passport with a fake alias Hussain Mubarak Patel.

It said that the Commander Kulbhushan Jadhav is responsible for acts of sabotage, espionage and multiple terrorist incidents in which scores of innocent Pakistani citizens were killed resulting into umpteen women being widowed and numerous children becoming orphans.

“This is a clear case of Indian state terrorism,” the Foreign Office added.

In the judgement read out by the Judge Abdulqawi Ahmed Yusuf at The Hague in Netherlands, the ICJ rejected the Indian plea for acquittal of Kulbhushan Jadhav, his release and return to India. However, the ICJ asked Pakistan to provide him consular access.
